In recognition of the health hazards that exist from side stream or secondhand smoke and in accordance with Section 19994.31 - 19994.32 of the Government Code and Section 42356 of Title 5 California Code of Regulations, the policy promoting a smoke-free environment has been revised. This revised policy is effective May 1, 2003.
Smoking is prohibited inside and twenty-five feet from all University and auxiliary organization facilities and in all vehicles owned or maintained by the University and auxiliary organizations. The word “facilities” includes but is not limited to exterior stairs, balconies, outdoor dining patios, outside athletic venues, bleacher and row seating for Rose Garden, Voorhis Park, and the Japanese Garden. Smoking at Kellogg West Lodge and Conference Center will be in compliance with their current policy and existing laws.
Some examples of areas where this policy prohibits smoking are the Engineering breezeway, hallways/balconies in Building 94, the Building 3/8 courtyard, the CLA Rose Garden Gazebo, CLA 2nd floor Paseo, CLA 4th floor patio, Campus Center, Campus Center exterior patio dining areas and the Children's Center.
Areas where smoking is not prohibited by this policy are the center of the Science/Engineering Quad, open area north of Building 1, grass area near the Rose Garden, grass area southeast of Building 7 near Camphor Lane, patio area northwest of Building 43, Center of the University Union Park, grass area southeast of Building 17, and southwest of Building 48 across Citrus Lane.
Sponsorship of any University activity or event by tobacco product manufacturers and/or the marketing or advertising of tobacco products on the campus is prohibited. Exceptions to this policy must be approved by the President or designee.
The University prohibits the sale of tobacco products and requests and recommends that the University's auxiliary organizations establish and maintain a policy that prohibits the sale of tobacco products on the University campus.
Deans, directors, and department heads are responsible for the administration of this policy. The Associate Vice President for Faculty Affairs and the Associate Vice President of Human Resource Services and Risk Programs are available to assist in policy interpretation and to ensure consistent application.
If any of the provisions of this policy are in conflict with the provisions of a collective bargaining agreement currently in effect, the provisions of the collective bargaining agreement shall prevail. All other non-conflicting policy provisions will continue in full force and effect.
It is anticipated that people will voluntarily comply with this policy when requested by concerned individuals. If this informal approach is unsuccessful, concerned individuals may contact the Environmental Health & Safety Department for assistance. Repeated or continual violations of this policy by employees will be handled through progressive discipline. Student violators will be subject to CSU student disciplinary procedures established pursuant to Section 41301, Title 5, of the California Code of Regulations.
