Copyright & Intellectual Property

Bronco Scholar abides by directives regarding intellectual property rights found in union documentation and adheres to any “work for hire” clauses in contracts of those employed by Cal Poly Pomona. Specifically, faculty retain the rights to reuse created materials according to Article 39 of the California Faculty Association (CFA)’s collective bargaining agreement. No equivalent clause is contained in the CSU Employees Union contract so staff submitting to Bronco Scholar should confirm the conditions of their hire to determine if the work they would like to deposit is considered “work for hire.” If the work is considered “work for hire,” the University retains copyright, otherwise the staff author retains copyright. The student(s) will retain copyright for works completed for senior projects, undergraduate or graduate research assignments, and as part of the fulfillment of a degree program at Cal Poly Pomona unless otherwise designated.

Works made available in Bronco Scholar are exclusively available for educational purposes, which may include research or instruction, unless otherwise indicated in the item’s rights statements. Literary rights, including copyright for published works held by the creator(s) or their heirs, or other third parties may apply. All rights are reserved unless otherwise indicated by the copyright owner(s).
