The Government Code entitles female employees up to 6 weeks of time off for normal pregnancy/delivery and up to 4 months for extended disability related to pregnancy and/or childbirth. This provision guarantees the employee time off from work and a right to return to her same/comparable position.
Non-Industrial Disability Insurance (NDI): The NDI program provides eligible employees with disability benefits for up to 6 weeks for normal pregnancy/delivery and for up to 26 weeks for complications of pregnancy/delivery or other extended disabilities.
Family Medical Leave: The Family Care and Medical Leave Act (FMLA) and the California Family Rights Act (CFRA) entitle eligible employees to up to 12 weeks of time off, with continuation of paid benefits, for a serious health condition or to care for a new child. In the case of pregnancy/childbirth, FML does not require that the mother be disabled or that the child be ill. Other than for pregnancy/childbirth, FML runs concurrently with other types of leave or disability programs. For pregnancy/childbirth, the FML 12 weeks does not commence until the Pregnancy Disability Leave--PDL (Government Code) ends.
Maternity/Paternity Adoption Leave: The Maternity/Paternity/
Adoption leave is a paid leave associated with the birth of an employee's own child or the placement of a child with the employee in connection with adoption or foster care.
Education Code (EC) Maternity Leave (89519) : The Education Code (89519) provides eligible permanent female employees with up to 12 months of time off due to pregnancy/childbirth. This period of time runs concurrently with other leave programs, and is not predicated upon disability. The Collective Bargaining Agreement (CBA) may take precendence for this leave, so please refer to the "Leaves of Absence Without Pay" section of the appropriate CBA for additional information.
