CPP Announces SB 98 Campus Alert Process in Event of Immigration Enforcement
Following recent changes to federal immigration policy and enforcement actions, the California legislature passed Senate Bill 98, which mandates that state universities notify the campus community about the presence of immigration enforcement action or routine immigration compliance activity on campus.
Per guidance from the CSU Chancellor’s Office, the notifications will be sent by email to current students, faculty, staff and auxiliary staff from SB98notify@cpp.edu and posted on the University’s Immigration Resources web page. The notification will be updated to reflect when the immigration enforcement of compliance activity has concluded and remain archived on the page for the academic year.
When is Cal Poly Pomona Required to Send a Campus Alert?
Immigration enforcement notices must be sent to the campus community when it is confirmed that there is active immigration enforcement activity or standard compliance visits by immigration enforcement personnel.
A compliance visit is a routine check to ensure that the institution is meeting its legal responsibilities for sponsoring and monitoring international students. If a compliance visit shifts to include enforcement activity, the university must send a new notification.
SB 98, also known as Sending Alerts to Families in Education (SAFE) Act, requires the mandated notifications to include:
- Date and time
- Location on campus of the immigration compliance or enforcement activity
- Link to university resources
The notice may not include any personally identifying information.
To prevent unnecessary alarm, immigration enforcement activity must be confirmed by the University Police Department and/or the designated university points of contact before the notification is sent to the campus community.
If an emergency situation develops, as defined under the Jeanne Clery Campus Safety Act, Cal Poly Pomona will follow established emergency protocols including the use of the Safety Alert system or issuing a Campus Safety Advisory.
If officers are executing a sealed warrant or conducting a classified investigation, the university could be prohibited by law from notifying the community about immigration enforcement activity.
Alerts will not be sent when an immigration officer is attending a university event for outreach, such as a career fair, or for training.
Consistent with CSU guidance, Cal Poly Pomona is not required to assist federal immigration authorities or grant permission to enter nonpublic areas of the university when officers do not have a judicial warrant or when exigent circumstances excuse that requirement. The university has designated staff members who will serve as a point of contact for any student, faculty or staff member who might be subject to an immigration order or inquiry on campus. These designated staff members will maintain personal privacy to the extent permissible by law.
If a student is detained or unable to continue academic requirements as a result of immigration activities, CPP will work with the student to assist in efforts to retain financial aid and to help them continue their education.
